Buying

Buying property in New South Wales could possibly be one of the most expensive decisions you will ever make and our aim is to assist you by simplifying the process and making it stress free.

Once you have found the property you wish to purchase we will work with you to undertake the entire process from pre-approval of finance through exchange of contracts until settlement and beyond.

We will assist you in all aspects of buying including:

  • Review the Contract both during the cooling off period and / or prior to making any offer or auction (even if you are not successful or do not proceed)
  • Assisting with organising pest, building and / or strata inspections
  • Liaising with your lender.
  • Providing advice with regard to your stamp duty obligations (including any reductions or exemptions you may be eligible for) and process stamp duty payments.
  • Undertaking all necessary searches and obtaining required certificates
  • Attending to settlement on your behalf.
  • Liaising with the real estate agent prior to and after settlement.

Selling

In New South Wales it is a legal requirement for you to have a Contract for Sale prepared before you advertise or list your property for sale. At JLR Conveyancing we will ensure that the contract is prepared specific to your requirements and available as soon as possible.

We will assist you in all aspects of selling including:

  • Taking your detailed instructions for the sale of your property
  • Forwarding the contract to your nominated Real Estate Agent.
  • Receiving a sales advice from your Real Estate Agent when the property has sold or undertake the exchange with the Purchaser’s representative on your behalf.
  • Liaising with your outgoing mortgagee to ensure that the mortgage is prepared for discharge.
  • Liaise with your Purchaser’s representative as we work towards settlement.
  • Explain to you and ensure you agree with settlement figures.
  • Undertake settlement on your behalf ensuring any mortgage is paid out, the Real Estate Agent is paid their commission and all documentation is processed effectively.
  • Forward settlement statements to you.

Title Transfer

Title Transfers can also occur without the need for a Contract for Sale in certain situations, including:

  • Transfer full or part ownership to your spouse.
  • Transfer full or part ownership to a related party.
  • Transfer altering how the property is owned between the current registered proprietors i.e. altering the tenancy arrangements.
  • Transfer pursuant to a Court Order i.e. due to separation or divorce.

At JLR Conveyancing we can undertake this on your behalf including:

  • Obtain and prepare the necessary documentation
  • Order a Stamp Duty Valuation
  • Attend to stamping the Transfer with Revenue NSW
  • Liaise with all parties including any outgoing and incoming mortgagee.
  • Attend settlement on your behalf and ensure that the Transfer is registered as required.

Deceased Estates

At JLR Conveyancing we also have extensive knowledge of deceased estates.

A Notice of Death is a document that is prepared and lodged when one of the registered proprietors on title has passed away and any surviving joint tenant/s now wish to have the property registered in their names.

A Transmission Application is a document that is prepared and lodged following a Grant of Probate or Letters of Administration. A Transmission Application can transfer the registered proprietor on title from the deceased to Executor/s or Beneficiary/ies.

Whilst a Grant of Probate or Letters of Administration would be prepared and filed by a lawyer, a Notice of Death or Transmission Application can be lodged by a Conveyancer. This may ultimately save you money.
